2Description of Service
Perfect Apex provides a platform for uploading, analyzing, and visualizing motorsport lap data. Our features include AI-powered insights, performance metrics, and multi-session data comparison tools.
3User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4User Data and AI Training
You retain ownership of the data you upload to the Service ("User Data"). By uploading User Data, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and analyze this data for the purposes of providing, maintaining, and improving the Service. This includes using your data to enhance our features and train our artificial intelligence models.
5Storage, Quotas, and Fair Usage Policy
Perfect Apex provides unlimited session uploads to support track day drivers and sim racers across all subscription tiers. To guarantee consistent performance, fast processing speeds, and infrastructure reliability for all drivers, storage is governed by this Fair Usage Policy.
A fair usage threshold of 15 GB per user account applies across all plans. If an account exceeds 15 GB in total storage consumption, we reserve the right to notify the account holder, and we may remove older historical telemetry files and session records only if system storage is constrained, in order to maintain reliable service for all users.
6Prohibited Conduct
You agree not to use the Service for any unlawful purpose or to engage in any conduct that could damage, disable, or impair the Service.
7Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied.
8Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
9Changes to Terms
We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
10Refund Policy
Due to the nature of our digital services, we do not offer refunds for any subscription fees or other charges. Once a payment is made, it is non-refundable. You may cancel your subscription at any time, and you will continue to have access to the service through the end of your billing period.
